Panel Persists with Deputy Governor Probe Despite Court Adjournment

Amidst legal intricacies, the investigative panel convened to scrutinize allegations of gross misconduct against Edo State’s Deputy Governor, Philip Shaibu, has resolved to continue its proceedings despite a recent court adjournment.

The decision was reached following objections raised by Shaibu’s legal representative, Prof Oladoyin Awoyale (SAN), who referenced a directive from an Abuja Federal High Court adjourning the case until April 8, 2024. The adjournment aimed to allow the concerned parties an opportunity to present arguments regarding an interlocutory injunction against the ongoing impeachment proceedings.

Retired Justice S.A. Omonuwa, heading the seven-man panel, clarified that the Federal High Court’s directive merely mandated the parties to appear and present their case but did not entail an injunction halting the investigative process.

During the deliberations, Ohaifa Joe, the Deputy Clerk, Legal, representing the Edo State House of Assembly, underscored that as per the Constitution’s provisions, particularly Section 188(10), no court possesses the authority to obstruct the House or the investigative panel from executing their constitutional duties. Joe challenged Awoyale to substantiate how the constitutional provision had been altered to support his objection.

Chairman Omonuwa affirmed the panel’s determination to proceed with the investigation and urged the House of Assembly to present its arguments.

In response, Awoyale conveyed that Shaibu would refrain from further participation in the investigative proceedings and sought the panel’s permission to withdraw. However, he clarified that his client’s withdrawal did not signify a relinquishment of the right to defend himself but rather compliance with the court’s directive to appear on April 8.

Awoyale reiterated that his actions were not a challenge to the panel’s authority but a commitment to adhere to the court’s instructions.
